Missouri is confiscating China-owned farmland within the state and other assets as part of its efforts to gather a $24 billion civil judgment.
A federal judge in Shaw ME state determined that on March 7, the Chinese government hid the start of a Covid-19 event, stocked up on medical protection devices, causing massive economic and personal harm to the nation as a whole.
US District Court Judge Stephen N. Limbaugh for the Eastern District of Missouri has imposed hefty rulings against China, its governing Communist Party, China's local government, the Wuhan Virgin Institute, and health agencies.
China each refused to participate in legal proceedings. Missouri Attorney General Andrew Bailey said on the issue:
China refused to appear in court, but that doesn't mean they will flee by causing inflated suffering and economic devastation. They intend to collect all pennies by seizing Chinese-owned assets, including Missouri farmland.
Bailey's office said it will consult with the Trump administration on how to move forward by grabbing the land.
There are no laws on foreign ownership
There is no law that absolutely limits the amount of private American farmland that foreigners can own. However, according to a Congressional report on foreign ownership and holdings of U.S. farmland, “some states have proposed to prohibit certain foreigners and entities from acquiring or owning the benefits of farmland within the state.” The USDA identifies 339 counties in Iowa, Kansas, Pennsylvania and Wisconsin, with the strictest restrictions on foreign ownership of farmland and other non-farm properties.
How much land does foreigners own in America?
As of 2021, it was owned by foreigners, businesses or countries that owned approximately 40.8 million acres of US farmland, according to the USDA. Canada is the largest foreign owner of US land, with nearly 13 million acres. Following this, the Netherlands has around 5 million people and Italy has 2.7 million. The Chinese part is relatively small, less than 1%, or about 384,000 acres. The top three states with Chinese-owned land are Texas, about 192,000 acres. North Carolina, approximately 49,000 acres. Missouri, approximately 43,000 acres.
Georgia Republican Rep. Mike Collins pointed out in a press release on July 26, 2023 that China's ownership of US land has increased by 30% since 2019.
The main concern among US policymakers is that China is purchasing certain land for spying purposes. In June 2024, the Treasury proposed a new rule that would give the US Foreign Investment Committee the ability to block Chinese companies from owning land near US military bases.
The aforementioned USDA data on Chinese land ownership does not account for 300 acres purchased by the Chinese manufacturer Fufeng Group, which was purchased in 2022 near Grand Forks Air Force Base in North Dakota. And it is not the first time a Chinese have purchased land near a military base. In May 2024, the Joe Biden administration issued an order enforced a China-backed cryptocurrency mining company from land owned near Wyoming, near Francis E. Warren Air Force Base, which houses nuclear weapons. Also, in 2018, a Chinese energy company subsidiary purchased the land near the Air Force's largest pilot training base at Laughlin Air Force Base in southern Texas.
Foreign sovereign immunity laws do not apply
Liu Pengyu, a spokesman for the Chinese Embassy in Washington, said his government has not acknowledged the recent Missouri ruling. According to the New York Times, he threatened “around.”
“The so-called litigation actually has no legal or international priority,” Liu said in a statement. “China will not accept it, and will not accept it. If China's interests are harmed, it will firmly adopt mutual measures in accordance with international law.”
