I think the Democratic Party is protesting too much. This twist on Shakespeare's line fits perfectly into Sunday's story.
That means some Democrats want to bring criminal charges against President Donald Trump for demanding a halt to vote counting on election night in 2020. Sarcasm (and hypocrisy)?
This is against the law, even though Democrats halted vote counting in many states on election night in 2020.
This, too, was definitely a violation of the law, says opposition commentator Norman Krieg. In fact, he cites state law to make his point.
But Democrats got away with it.
Legal liberalism for me, legal liberalism for you
Krieg calls the incident “a classic example of inaction.” It reminds him of a joke about a man who murders his parents and then begs for mercy, he writes. why? He deserves leniency because he is an orphan, the defendant says.
And in today's America, Justice may feel like an orphan. As a case in point, Krieg points to a 2023 Just Security article written by Professors Andrew Wiseman and Ryan Goodman. The researchers, titled “The Missed January 6th Indictment: The 'Count the Count' Plan,'' predicted that Mr. Trump would be indicted in this way. What exactly? scholars write:
An early step in the conspiracy to disrupt the peaceful transfer of power was a coordinated plan to “stop counting” ballots after polling places were closed on election night. This scheme can and should be prosecuted under the (18 USC) 1512 Obstruction Act and the … (18 USC) 241 Act (against conspiracy to deprive of constitutional rights).
Now, President Trump has called for a halt to the counting of electoral votes. But, as Krieg points out, he wasn't committing a crime.
He was responding to one of them.
It's voter fraud and subsequent cover-up.
But the sausage was made, made
Now infamously, vote counting was halted in Georgia, Pennsylvania, and North Carolina. Michigan and Wisconsin also had suspiciously “frozen” return numbers. The most shocking thing happened at Atlanta's Fulton County Stadium. Officials apparently stopped the count and sent other employees home “to justify a non-existent leak,” Krieg wrote.
And it was these interruptions that arguably prompted President Trump to hold a press conference in the early morning hours of election night. At that time, President Trump said at 2:29 a.m., “We want all voting to stop. We don't want people finding their ballots in the morning and adding them.”
Note that this is the main reason why two-thirds of Republican voters believe the 2020 election was stolen. (Nearly 3 in 10 Americans overall agree.) In fact, someone who knows how to make sausages, Democrat and former Illinois governor Rod Blagojevich, agrees. He said at the time that Democrats were stealing the election after seeing the election halted.
more than suspicious
These outages were also more than just questionable. Per Krieg:
In fact, these suspensions were illegal, and therefore any votes counted afterward were likely invalid or even null and void. South Carolina, Pennsylvania, Georgia, and Nevada, among others, had clear language in their election laws prohibiting the suspension of counting, perhaps for the obvious reason that halting counting would present a ripe opportunity for fraud. Probably the body.
For example, Pennsylvania's Section 1222 states, “…the election official shall immediately begin campaigning and counting the votes, and shall not suspend or postpone the campaigning or counting until complete completion. ” is stated. (Emphasis added.)
Section 630 of the Georgia Election Code provides further details and points out the gravity of the issue.
Voting officials shall immediately begin campaigning and count the votes cast. and must not be postponed or postponed until the canvas or calculation is completely completed. However, at the discretion of the poll administrator, polling staff may stop counting after all races and questions have been counted. However, only when the results of these races and questions are posted for public information outside the polling place, the ballots are returned to the ballot box and left with the Superintendent until counting resumes the next day. . (Emphasis added.)
Alarmingly, even before the election, secretaries of state across the country were already considering halting vote counting. In October 2020, during a debate at the Election Night Reporting Roundtable, New Mexico's Maggie Toulouse Oliver cited concerns about “humanity” to keep poll workers fresh. We informed the other state secretaries in advance of our plan to suspend counting. Was her speech an implicit command of glances and nods to her fellow travelers? Was she the central authority figure coordinating the strange election night commotion?
blame the victim
In other words, we don't need evidence of voter fraud (which actually happened) to prove that 2020 was an illegal election. If Krieg's interpretation of the relevant statute is correct and sufficiently clear, then its violation alone would make it illegal.
But this is why Krieg speaks of chutupa and bile. Democrats are hoping that Trump will face criminal charges just for demanding that vote-counting be stopped, and they certainly want him to go to jail. However, the Democratic Party actually halted the vote counting in clear violation of the law. Again, President Trump's call was against Democratic Party misconduct.
There are two more issues. As I have previously documented, there are cases (and there are court rulings to prove it) of Democrats stealing elections from other Democrats. That massive voter fraud is occurring is a fact, not a tinfoil hat fantasy or just an opinion.
Second, delaying election results as things stand is a perversion of the system. Throughout my adolescence and young adulthood, final election results were announced and anticipated on election night. Then there was the Bush-Gore contest in 2000, when officials were seen on television dissecting “Hanging Chad.” As a result, complaints were made that the technology was outdated. Electronic voting machines are needed to make the process fast, reliable, and seamless.
We now have that technology, and delays in election results are commonplace. But strangely, these delays virtually always occur in swing states and regions controlled by Democrats. (Pro tip: The problem isn't the technology, it's the confusion.)
Oh, another hypocrisy. Professors Wiseman and Goodman also wrote in their allegations against Mr. Trump:
For more than 100 years, the Department of Justice has used Section 241 with great success to prosecute conspiracies to prevent the proper counting of votes in federal elections.
Funny how they didn't apply that to the 2020 Democratic party and swing state shenanigans.
