The request for Gensler's private communications appears to have been too much for the SEC to handle, which described the subpoena as “clearly fraudulent.” In a June 28 court letter, the SEC argued that U.S. District Judge Katherine Polk Failla of the Southern District of New York (SDNY), who is presiding over the case, should deny Coinbase's request.
