Again, the Democrats on the far left are running to federal court to stop one of President Donald Trump's executive orders. This time, they want to stop Trump from voting fraud and banning non-citizens' votes.
The list of plaintiffs includes Chuck Schumer (DN.Y.), the US Senate minority leader, and Hakeem Jeffries (DN.Y.), the US minority leader, at the top of the Democratic political group.
Their claim: Trump's executive order – maintain and protect the integrity of American elections – and the officials who enforce it trespass the separation of power and violate the Administrative Procedure Act.
One of the plaintiffs' main concerns is Trump's mandate that voters provide evidence of citizenship. Of course, it blocks illegal terminations, including millions who have Social Security numbers and already vote – casting votes. That would be a huge blow to the Democratic candidate.
order
The March 25th Trump order requires enforcement of federal election laws, which defines the date and time of an election, particularly when votes are counted, which requires only US citizens to be allowed to vote in federal elections. Citizenship proof must be voted.
Orders also require a paper record for voting, and voting using barcodes is prohibited. They also withhold federal funds from states that refuse to comply with federal laws that regulate votes.
Perhaps the most important codicil of the order is that evidence of citizenship is necessary. Why: As reported by New American on March 31, government efficiency found that at least 2.1 million illegals have registered with Social Security and 5.5 million have registered with all benefits programs. Worse, many people voted.
“We will punish alien citizenship and false statements of votes by citing US codes 1015 and 611,” Trump's order said “we will properly fail voter citizenship.” Similarly, the Department of Justice does not enforce these laws. “What's worse, previous administrations actively prevented the state from removing aliens from the voter list,” the order said.
In the future, in order to prevent foreigners from voting, the National Post voter registration form will require “Certification of US Citizenship Documentary in line with 52 USC 20508(b)(3).” Similarly, state and local officials must record the documents voter applicants use to prove their citizenship.
Citizenship proof includes a US passport, actual ID, a military ID card indicating US citizenship, or a valid federal or state ID proof of citizenship.
That alone was full of Democrats. But the other parts of the order were as well.
Litigation
The 11-count complaint on page 74 alleges separation of power and countless violations of the Control Procedure Act.
Count 1 says the president “dramatically exceeds very limited constitutional and statutory powers when it comes to regulating elections.” His order does not identify the source of legal authority.
Counts 2-4 alleges a violation of separation of power on three grounds.
Illegal intrusions against Congressional authorities. Illegal intrusions against national authorities. Taking the Parliamentary Expenditure
The remaining counts alleges violations of the Administrative Procedure Act, which governs the way federal agencies implement rules and regulations.
These initial allegations under the APA order all votes so that Trump can receive and count on Election Day. But most of the rest cites the true purpose of the litigation. It is to allow illegal foreigners to vote.
The second and third allegations address evidence of Trump's mandatory citizenship.
Another APA complaint argues that enacting the order is “action contrary to the Fifth Amendment” because it requires state authorities to check the citizenship of welfare recipients before allowing them to register in federal elections.
The 5th APA complaint states that the order trespasses privacy laws. This also involves citizenship issues, as the Department of Homeland Security requires the state to provide access to immigration data.
The sixth APA complaint also deals with citizenship. The organs enforce the order say, among other reasons, it violates the first and fifth amendments of the U.S. Constitution, because “nearly 9% of American citizens of voting age do not have access to the documents necessary to prove their citizenship.”
Prove citizenship for these presumed voters is a “overburden,” the lawsuit argues.
As the APA continues, “in violation of American voting laws,” the order requires states to comply with an order or face that will lose federal funds, among other so-called unconstitutional acts.
The APA complaint alleges that the order is “arbitrarily and whimsical.”
Related Democrat Octopus
Allowing illegals to vote is an important priority for Democrats, given the Biden administration's efforts to land on the southwest border and then import millions by releasing it to the country.
And they didn't count 530,000 Cubans, Haitians, Nicaraguans and Venezuelan Biden.
Therefore, many of the weapons in the far left Delktopath joined the lawsuit. Again, Schumer and Jeffries, the Democratic National Committee, the Democratic Governors' Association, the Democratic Senate and Congressional Committee.
Safe Family Initiative, the Arizona Student Association, and the Open Border Coalition on the far left of the Unified Latin American Citizens' Federation (LULAC) have appealed as well.
The 52-page complaint resembles a claim against a democratic lawsuit. Lulac dislikes the order being illegal because it often doesn't have the necessary citizenship documents, especially those eligible to vote.
If it's true, maybe they should get some.
