“Appellant KalshiEx LLC (“LLC”) knew that this Court's review was imminent and rushed to enter into its election wagering agreements on the same day the district court issued its memorandum opinion, before appellant the Commodity Futures Trading Commission (“Commission” or “CFTC”) had an opportunity to file this motion to stay its appeal on significant legal and public interest issues,” the CFTC said in its filing.
