As of July 21, 2024, there were 662,566 noncitizens with criminal records on ICE's National Roster, which includes those in ICE custody, and on the agency's Non-Detainer Roster. Of these, 435,719 have been convicted and 226,847 have criminal charges pending.
The attached graph shows that the number of criminals and criminal suspects is slightly lower, with the number of absconders and free (not in custody) at 425,431 and 222,141. Total number of thugs on the prowl: at least 647,572.

“ICE is bound by a legal requirement that certain noncitizens not be released from ICE custody while deportation proceedings are pending, and most noncitizens convicted of murder are typically not released. Note that you are not eligible,” Rechleitner wrote under the Immigration and Nationality Act.
However, “ICE officers may use their discretion to make detention decisions and conditionally release noncitizens,” the letter continued.
ICE's detention decisions are made on a case-by-case basis and consider the circumstances of each individual case, primarily considering flight risk, national security threat, and threat to public safety.
Translation: ICE agents can release murderers into your hometown if they want. The same applies to rapists, drug dealers, and of course gang members and terrorists.
